Okay- bear with me.
Some might remember me asking these questions while we were gathering docs/filing our AOS.
Brief Timeline: 5/10-AOS sent out, 5/14- AOS received, 5/20-NOA 1, 5/23- Biometrics App. Scheduled for 6/12.
So my main 2 concerns for my husbands AOS were/are
1. Medical Exam
He completed all the required vaccinations, x-rays, labs, etc. The civil surgeon did NOT mark off the "K-1 applicant voluntarily completed all vaccinations" box on the back (at least for the copy we have). I didn't notice this until we were filing, but given he was out of status, we decided it was best to file with the DS-3025 and see if we got an RFE. I did send a message to the Civil Surgeons office abroad to ask about the worksheet. He told us to mark the box off ourselves. I, as well as others, determined this was very ill advised and we should not do this to prevent being accused of fraudulent docs. Another person also mentioned to not include the text thread of the civil surgeon telling me to do so, to not bring question to his credibility. He did provide a pdf of the page in question (corrected), but the incorrect box was checked (Immigrant box was checked). I decided to not include any of this in the AOS as I wasn't sure if he filled out the correct boxes in the original copy that was anded to the immigration officer upon entry. Some commented it was weird that he only received Pertussis and not the full TDAP, but other than that, everything was good. MY QUESTION: We live 4 hours away from Anchorage (where our biometrics appointment is), so I want to schedule a Civil Surgeon appointment on the same day as biometrics. However, I don't want to waste money on the appointment, but prefer to do that instead of delaying the process with a potential RFE. What do you guys think, should I wait for RFE or should I do it on our upcoming trip? I was planning on uploading this in the unsolicited evidence section in his USCIS Account.
2. Joint-Sponsor Affidavit of Support
When we filed, our joint-sponsor had not yet filed his 2024 Tax Returns. We filed on 5/10, so it was after the federal deadline. Since then, he has filed his returns, and I uploaded a copy of the tax return in the unsolicited evidence section. MY QUESTION: On the original Affidavit, our joint sponsor checked "NO" when asked if he filed a tax return for the 3 most recent tax years (as his most recent filed was 2023 and he was filling out the Affidavit in early May). Does this call for a new affidavit of support to be filled out and submitted?
Obviously I am doing everything I can to prevent delaying the process with an RFE. Chat gpt told me I could call the USCIS support line and ask, but the info they can give is limited in terms of advice on such situations. It did say, however, that the representative is able to tell me if there is an upcoming RFE after the biometrics. Is this true?
I also see there is an option in the account to send a message to an Immigration Officer, but on the drop down, no such category is described.
